Texas Administrative Code Rule 1.14, sets forth the THECB's negotiated rulemaking process.

House Bill 449, 86th Texas Legislature, relating to a requirement that public and private institutions of higher education include a notation on a student’s transcript under certain circumstances, amends TEC Chapter 51 by adding Section 51.9364, Certain Notations Required on Student Transcripts. The legislation requires the THECB to adopt rules for the administration of this Subchapter.

Senate Bill 25, Sections 8-10, 86th Texas Legislature, amends TEC Section 61.821 by adding Subdivision (4), amends Subchapter S by adding Section 61.8221, and amends Section 61.827. The legislation requires the THECB to establish an advisory committee to assist the Board of the THECB in completing the board’s duties under Section 61.8221 and provide the board with subject matter expertise and analysis. The legislation also requires the THECB to develop rules regarding the recommended core curriculum developed under Section 61.822.

Senate Bill 212 and House Bill 1735, 86th Texas Legislature, relate respectively to the reporting of and the development of policies regarding certain incidents of sexual harassment, sexual assault, dating violence, and stalking at public and private institutions of higher education. Each bill amends certain sections of TEC Chapter 51. SB 212 requires the THECB to adopt reporting rules. HB 1735 requires the Commissioner of Higher Education to establish an advisory committee to make recommendations to the Board of the THECB regarding rules as necessary to implement and enforce certain provisions of the new legislation and develop recommended training for Title IX coordinators at postsecondary educational institutions.
